MoM Ardbeg 2018 Competition Terms
THE PROMOTER
The Promoter is Master of Malt or otherwise known as MoM. Just so you know, our legal name is Atom Supplies Limited. We are a company registered and incorporated in England and Wales with the company register number 03193057 and having its registered office at Unit 1 Ton Business Park, 2-8 Morley Road, Tonbridge, Kent, TN9 1RA, United Kingdom.
ARE YOU ELIGIBLE?
The Ardbeg 2018 competition (the Competition) is only open to private individuals who are 18 years old or older (and of legal drinking age to purchase alcohol in their country of residence). Ineligible entries (howsoever received) will be discarded.
The Competition is not open to any employees of Atom Supplies Limited or any of its associated companies (including MoM), their families or friends.
HOW TO ENTER
The Competition Period shall commence at 12:00:01 pm on 20 November 2018 and end at 23:59:59 pm on 24 December 2018.
Entrants will be automatically entered into the Competition if they complete the purchase of any 70cl bottle from the Ardbeg distillery range from the MoM website in accordance with MoM’s standard Consumer Terms of Business during the Competition Period (each being a Qualifying Purchase). There is also a no purchase entry option, which you can read about below.
By completing a Qualifying Purchase, you are agreeing to be bound by these terms and conditions.
Multiple entries are permitted, encouraged even!
References in these terms to the completion of the purchase of a product shall be construed as a reference to the time at which the purchaser receives an email from MoM which confirms that we have dispatched the order. Any person who cancels a Qualifying Purchase, by any method whatsoever and whether before or after dispatch, shall be disqualified. Any person whose Qualifying Purchase is not made in accordance with MoM’s Consumer Terms of Business shall be disqualified. Any person whose Qualifying Purchase is cancelled by MoM owing to factors outside of MoM’s control (including import restrictions) shall be disqualified. Nothing in these terms shall prevent any Entrant whose Qualifying Entry is disqualified for any reason from making a separate, new Qualifying Purchase.
Alternatively, no purchase is necessary to enter the Competition. Any person who sends a postcard or letter to Master of Malt, Unit 1, Ton Business Park, 2-8 Morley Road, Tonbridge, Kent, TN9 1RA, United Kingdom (marked for the attention of the Marketing Team) casually mentioning the fact that they wish to enter the Ardbeg 2018 Competition and setting out their name and contact details shall be entered into the Competition, provided that the postcard or letter is received prior to the expiry of the Competition Period. By entering the Competition in this way, the Entrant confirms that he or she is eligible to do so and that they are agreeing to be bound by these terms and conditions. Each entry received in accordance with this section will be entered into the Competition as though it is was a Qualifying Purchase. MoM will not be responsible for any entries which are lost or delayed in transit, regardless of cause including, for example, as a result of any failure of any postal system of any kind. MoM will not accept proof of posting as proof of receipt of entry to the competition. Postcards and letters will not be returned.
HOW TO WIN
Three Winners (each being a Winner) will be selected as soon as practicable after the Competition Period at random from all Qualifying Entries by MoM in MoM’s absolute discretion. The selection made will be final and no correspondence or discussion will be entered into.
WHAT IS THE PRIZE?
Each Winner will win a 3 days-2 nights trip to Islay for 2 people consisting of the following (the Prize):
(i) complimentary standard return plane or train travel between 1 January 2019 and 31 December 2019, excluding bank holidays and certain festival periods (including but not limited to during Feis Ile), from any single named point of origin within the United Kingdom to Islay, and transfers to and from Ardbeg distillery, for two people (the mode of transport and all details of transport will be decided by Moët Hennessy);
(ii) two nights’ complimentary accommodation at the Seaview Cottage* at Ardbeg distillery;
(iii) complimentary VIP tour to the Ardbeg distillery (including a unique tasting of Ardbeg expressions from a cask in the warehouse with Micky Heads, subject to availability in Moët Hennessy sole and absolute discretion, and food pairing & tasting in the chairman’s study); and
(iv) subject to availability and weather conditions (and at Moet Hennessy’s absolute discretion), Winner may be offered one of the following enhanced Ardbeg activities such as Island Tour, boat trip to Corryvreckan Whirlpool, Island Sea and Wildlife Tour, Helicopter Tour of Islay or Sea Fishing.
*Please note that the Winners and their guests may be required to share Seaview Cottage with other guests also staying at the cottage during their stay. Seaview Cottage is a former home of the Ardbeg Distillery Manager – it is a self-catering, 2-storey semi-detached home in the grounds of the Ardbeg Distillery with 3 en-suite bedrooms that sleeps up to 6 people. The cottage features an open plan kitchen, dining and living area and there are no locks on the bedroom doors. Neither MoM nor Moët Hennessy shall in any circumstances be responsible for any lost, missing, stolen or damaged personal items during the Winners’ and their guests’ stay at the Seaview Cottage. Winners and their guests will not be able to demand exclusive use of the cottage. Other conditions of stay may apply.
The Prize is provided by Moët Hennessy UK Limited (Moët Hennessy), and cannot be exchanged for any equivalent cash value or for other items. The Prize is not negotiable or transferable. MoM takes no responsibility for the provision of the Prize and will not be liable for any issues or losses which arise as a result of the provision of (or failure to provide) the Prize by Moët Hennessy.
Not all dates are available; any bookings are subject to availability and to be agreed with Moët Hennessy.
All travel and accommodation arrangements relating to the Prize will be Moët Hennessy’s responsibility. Travel dates and relevant reservations once notified to the Winner cannot be changed, postponed, or cancelled (except in relation to extension of stay as set out below).
The Prize is strictly non-transferable, not negotiable and no cash alternative shall be available. Any other costs incurred (including but not limited to travel insurance, cost of transfers to and from airports or stations, other travel and accommodation expenses, spending money, personal items, food and drinks, tax or personal expenses) otherwise not specified in these terms, which are incidental to the fulfilment of the Prize are the responsibility of the Winners and their guests. Any costs incurred by reason of missed flights or other Prize elements will be the sole responsibility of the Winners and their guests.
If the Winners and their guests are based outside the United Kingdom, the Winners and their guests will be responsible for all costs of travel to the United Kingdom, and for arranging that travel. If the Winners are not able to make such arrangements, they will automatically forfeit the Prize.
The Winners and their guests may elect to extend their stay. Return travel to the relevant United Kingdom address after an extended stay will be included, but all other costs will be for the Winners and their guests. If the Winners and their guests wish to extend their stay, they must let MoM know when claiming their Prize.
The Winners and their guests will be responsible for ensuring that he/she will be available to travel and will hold valid passports, any necessary visas and travel documents incidental to the fulfilment of the Prize on the travel dates to be specified by Moët Hennessy.
It is at MoM’s sole and absolute discretion to offer or not offer the Prize for different dates or to a different Competition Entrant if a Winner is unable to take up the Prize on any specific travel dates to be provided by Moët Hennessy.
WINNER ANNOUNCEMENT AND HOW TO CLAIM THE PRIZE
The names of the Winners will be announced on the MoM blog as soon as practicable after the end of the Competition Period.
In order to accept the prize, the Winners shall be required to agree that we can use his or her name and county, state or region of residence (as applicable) when announcing the Winner of the competition and for other reasonable and related promotional purposes (nothing sinister, and we won’t sell the Winner’s or any other entrants’ details to anybody else – we promise). MoM may contact the Winners for feedback in respect of the Competition and/or Prize and may use any feedback provided when announcing the results and promoting the Competition or subsequent competitions.
MoM will make reasonable efforts to contact the Winners on the date of the announcement using the contact information provided in connection with the Qualifying Purchase. If any Winner cannot be contacted or is not available or has not claimed the Prize within five days of the announcement date, MoM reserves the right to offer the Prize to another eligible Competition Entrant. MoM cannot accept any responsibility if the Winner is unable to take up the Prize.
MoM will send the name and county of the Winners to anyone who writes within one month after the end of the Competition Period requesting details of the Winners and who encloses a self-addressed envelope to the address set out herein.
LIMITATION OF LIABILITY
Insofar as is permitted by law, the Promoter, its agents, employees, and/or representatives shall in no circumstances be responsible or liable to compensate the Winners who claim the Prize or any Entrants for any loss, damage, personal injury or death whatsoever and howsoever caused, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any direct, indirect or consequential losses arising out of or in connection with the Entrants’ participation in the Competition, any failure or delays, postponements, or cancellations in making the appropriate travel and accommodation arrangements as a result of the Winners taking up the Prize (including in relation to their guest), except where it is caused by the negligence of the Promoter, its agents, employees, and/or authorised representatives. Competition Entrants’ statutory rights are not affected.
DATA PROTECTION
MoM is committed to protecting your privacy, in particular in compliance with the GDPR. MoM will only process your personal information as set out in MoM’s Privacy Policy (as amended from time to time), a current copy of which is available at: https://www.masterofmalt.com/c/privacy-policy/.
By entering into the Competition, the Entrant is accepting and consenting to the terms of MoM’s Privacy Policy and to the way MoM processes their personal information.
Once the Winner has claimed the Prize, MoM will notify and pass their personal details to Moët Hennessy in order for them to fulfil the Prize. Once MoM passes the Winner’s (and their guest’s) details to Moët Hennessy, Moët Hennessy will be deemed the controller of the personal data and will handle that information in accordance with their Privacy Policy. Moët Hennessy will make contact with the Winner and will be responsible for organising any travel and accommodation itinerary part of the Prize.
GENERAL
MoM reserves the right to hold void, suspend, cancel or amend the Competition where it becomes necessary to do so. If there is any reason to believe that there has been a breach of these terms or any attempt to circumvent or to frustrate them, MoM may, in our sole discretion, exclude any person from participating in the Competition.
These terms shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
